Hartz Chicken Contest Terms and Conditions

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

This Contest is owned and operated by Hartz Franchise Restaurants, Ltd., a Texas Limited Liability Company (“HFR”)

1. PARTICIPATION IN CONTEST CONSTITUTES ACCEPTANCE OF TERMS AND CONDITIONS

Your access to and participation in this Contest is subject to these terms and conditions ("Terms and Conditions"). HFR may revise these Terms and Conditions at any time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound. Your access to and participation in this Contest constitutes your unconditional agreement to be bound by these terms and conditions.

2. ELIGIBILITY

  1. To be eligible to participate in this Contest, you must be at least eighteen (18) years of age and a legal resident of the United States (including the District of Columbia and Puerto Rico) at the time you enter the Contest. Employees of HFR and any other companies assisting HFR in conducting this Contest, including their respective parents, subsidiaries, affiliates, employees, as well as the immediate family (parents, siblings, spouses, children, and household members) are not eligible. Entries in violation of these rules as determined by HFR in its sole discretion are ineligible.
  2. If the prize winner does not meet eligibility requirements or forfeits the prize, the prize may be awarded to the next randomly drawn eligible participant.
  3. Winners will be notified text and given two weeks to claim their prize. Failure to respond within that time will result in forfeiture of the prize and a new winner may be randomly drawn.

3. PRIZES

  1. The type, number and approximate value of the prizes is as follows:
    - 1 pair of Air pods, 1 Xbox console, 4 Flatscreen Tv’s, 2 Samsung tablets & 2 Apple watches each valued around $500
    - 10 prizes in total, only one prize per winning contestant.
  2. All prizes are non-transferable and there will be no cash substitutes or other substitutes except that HFR reserves the right to substitute a similar item if the original prize is no longer available. The winner is solely responsible for all federal, state, and local taxes, if any, with respect to the prize.
  3. HFR shall randomly draw all potential prize winners from all eligible entries received on the following dates:

* 10/01/2022 – 10/31/2022

The odds of winning depend upon the number of eligible entries received.

4. CONTEST PERIOD

The Contest shall operate from October 1, 2022 through October 31, 2022. Only entries received during this time frame shall be eligible to win.

5. HOW TO ENTER

  1. To enter the Contest, you may send the keyword “HARTZ” to (888) 310-0291. Limit of one entry per person, regardless of the method of entry.
  2. HFR is not responsible for lost, late, incomplete, damaged, invalid, unintelligible, illegible, misdirected or postage-due requests or entries, all of which will be disqualified.
  3. If you choose to enter using your mobile device, standard data fees may apply. You should consult your wireless service provider’s pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier. You should also check your device’s features for capabilities and check the device manual for specific use instructions.
  4. Duplicate Submissions by the same entrant will be subject to disqualification. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different cell phone numbers, identities, registrations, or any other unauthorized methods will void that entrant’s entry and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

6. LIMITATION OF LIABILITY

  1. YOU AGREE THAT HFR AND ITS AFFILIATES, PARENTS, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, PARTNERS (GENERAL AND LIMITED) OR THEIR MEMBERS AND MANAGERS, AND FRANCHISEES WILL NOT BE RESPONSIBLE OR LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF YOUR PARTICIPATION IN THE CONTEST INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INCIDENTAL, PUNITIVE AND CONSEQUNETIAL DAMAGES, AND DAMAGES RESULTING FROM THE LOSS OF USE, DATA, PROFITS OR BUSINESS INTERRUPTION ARISING FROM OR IN ANY WAY CONNECTED WITH PARTICIPATION IN THE CONTEST. THIS ALSO INCLUDES DELAYS IN BEING ABLE TO ENTER THE CONTEST, THE INABILIITY TO ENTER THE CONTEST, WHETHER BASED ON TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF HFR OR ITS SUBSIDIARIES, AFFILIATES OR FRANCHISEES WERE AWARE OR HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This disclaimer constitutes an essential part of these Terms and Conditions.
  2. HFR AND ITS AFFILIATES, PARENTS, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, PARTNERS (GENERAL AND LIMITED) OR THEIR MEMBERS AND MANAGERS, AND FRANCHISEES ARE NOT LIABLE FOR THE WINNER’S FAILURE TO RECEIVE NOTIFICATION OF WINNING UNDER ANY CIRCUMSTANCES.

7. LEGAL

a) You agree that this Contest will be governed by the laws of the State of Texas, without application of its choice-of-law principles. By entering this Contest, you consent to the exclusive jurisdiction in the State of Texas with venue exclusively in Harris County, Texas in all disputes (i) arising out of, relating to, or concerning this Contest and your participation or attempted participation therein.

b) HFR reserves the right to modify, suspend, cancel or terminate the Contest if non authorized human intervention, a bug or virus, fraud or other causes beyond HFR’s control impact or corrupt the security or fairness, proper conduct, or administration of the Contest.

8. WAIVER OF RIGHTS

YOU AGREE TO WAIVE, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, ANY CLAIM FOR PUNITVE OR EXEMPLARY DAMAGES AND ANY RIGHT TO PURSUE CLAIMS ON A CLASS OR CONSOLIDATED BASIS OR IN A REPRESENTATIVE CAPACITY, WHICH RELATE IN ANY WAY TO THIS CONTEST.

9. MISCELLANEOUS

  1. You agree that HFR may change any of these Terms and Conditions at any time without notice to you.
  2. You agree that no joint venture, partnership, employment or agency relationship exists between you and HFR, its affiliates, subsidiaries, licensors, and Franchisees as a result of these Terms and Conditions or the Contest.
  3. Any right not expressly granted to you herein is reserved by and to HFR, its affiliates, subsidiaries, licensors, and Franchisees.
  4. These Terms and Conditions constitute the entire Agreement between you and HFR with respect to the Contest. These Terms and Conditions supersedes all prior or contemporaneous communications, whether written, oral or electronic, between you and HFR with respect to the Contest. No modification of these Terms and Conditions shall be effective unless such modification is authorized in writing by HFR.
  5. Any actual or alleged waiver by HFR of any actual or alleged breach of these Terms and Conditions by you shall not be deemed to be a waiver of any future breach.
  6. A printed version of these Terms and Conditions shall be admissible in judicial, administrative and/or other legal proceedings based upon or relating to this Contest to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by HFR in printed form.
  7. If any part of these Terms and Conditions is found to be invalid or unenforceable under applicable law, you agree that the invalid or unenforceable provision will be superseded by a valid, enforceable provision that most closely matched the intent of the original provision and that the remainder of these Terms and Conditions shall continue to govern your use of this website.
